Australian Business Fined for Alleged Unlawful Advertising of Vaping Products

The Therapeutic Goods Association (TGA) has issued multiple infringement notices to an Australian business amounting to $93,240 (AUD) for alleged unlawful advertisement of nicotine vaping products.

The organisation was also ordered to immediately remove all offending advertisements from its website.

The TGA explain in a recent article:

"Under the Therapeutic Goods Act 1989, vaping products that contain nicotine are prescription only medicine…and cannot be advertised to the Australian public."

This is the latest in a series of compliance actions related to the alleged unlawful advertisement of nicotine vaping products by Australian individuals and organisations.

Similar examples of alleged offending are described by the TGA here and here.

The consequences of non-compliance can be hefty. No matter your product offering, stay informed, and stay compliant.
